Appeal from Pollc District Gourt. — ITon. W. F. Conrad, Judge. Suit in equity to establish a trust upon certain funds in the hands of thé defendant, and for judgment for the amount of plaintiff’s claim. The answer was, in effect, a general denial. Trial to the court, decree for plaintiff as prayed, and defendant appeals.

Tbe Lewis Investment Company was a corporation organized under the laws of this state, for the purpose of making loans from its own funds, as well as for investing and loaning money belonging to others. Its capital stock was one hundred and fifty thousand dollars. It selected the Des Moines National Bank as its banker, and opened an account with, it in May of the year 1891. With this bank it did a large business, and its transactions were quite similar to those of the other customers of the bank.
