Julius J. Koos and Jeanne J. Koos filed a petition in the superior court of Cook county for a writ of mandamus to compel the village of LaGrange, its president and trustees to issue a permit for the construction of a gasoline service station upon a parcel of ground owned by the petitioners. The defendants filed a demurrer to the petition, the demurrer was sustained and the petition was dismissed. The court certified that the validity of a municipal ordinance was involved in the case and that the public interest required a direct review by this court. An appeal was prayed but not perfected.…
