Appeal from an order of the Supreme Court (Best, J.), entered September 7, 2000 in Montgomery County, which, inter alia, denied a motion by defendant Latham Four Partnership for summary judgment dismissing the complaint against it.

On December 29, 1995, plaintiff Peter J. Sajta (hereinafter plaintiff), a maintenance employee of Avion Management Corporation, was directed to go to a commercial building in the Town of Colonie, Albany County, that was owned by defendant Latham Four Partnership, for the purpose of spreading calcium chloride on a mound of ice which was impeding vehicle…
