Appeal from that part of an order of the Supreme Court (Teresi, J.), entered September 13, 2000 in Albany County, which partially denied defendant City of Albany’s motion for summary judgment dismissing the complaint against it and granted plaintiffs’ cross motion to amend the complaint.
