MEMORANDUM AND ORDER
YOHN, District Judge.
Defendant Southeastern Pennsylvania Transportation Authority (“SEPTA”) has filed a motion for partial summary judgment on the ground that the doctrine of sovereign *129immunity bars plaintiffs claims under Pennsylvania’s Hazardous Sites Cleanup Act (“HSCA”), 35 Pa.Stat. §§ 6020.101-6020.1305 (1993). For the reasons explained below, the court denies SEPTA’s motion.
