MEMORANDUM
BAYLSON, District Judge.
The issue presented is whether the insurance carriers which issued directors’ and officers’ policies to Adelphia Communications Corporation (“Adelphia”) must advance defense costs to five of its former officers and directors. Presently before the Court are a Motion for Partial Summary Judgment to Require Advancement of Defense Costs by Defendants John J. Rigas, Michael J. Rigas, Timothy J. Rigas and James P.
