Petitioner-Appellee Cross-Appellant James Drain (“Drain” or “Petitioner”) was convicted of first-degree murder, felon in possession of a firearm, and felony firearm. After the Michigan Court of Appeals affirmed the convictions and the Michigan Supreme Court denied review, Petitioner moved for relief from judgment. The Michigan trial court granted Drain’s motion on a number of grounds, including that the trial court failed to remedy the prosecutor’s violations of Batson v.
