Before the court are Motions for Summary Judgment (docs. 90, 95) filed by defendants Lovette and the Town of Butler, Alabama, and by defendant Jackson, respectively. 1 A hearing was held on the motions on June 14, 2007.

The court has previously granted in part defendants’ Motion to Dismiss. (Doc. 58). In that order, the court denied defendant Jackson’s Motion to Dismiss, brought on the grounds of qualified immunity and granted defendant Lolley’s Motion to Dismiss on qualified immunity.
