This suit was brought by C. P. Grotty and others against Thomas B. Swann, administrator of the estate of Stewart Eagle, deceased, in the Circuit Court of Kanawha county, for the purpose of obtaining a settlement of the account of said *144administrator, and a disbursement of the assets in his hands among the distributees entitled thereto.
