This was a bill in chancery, brought in the circuit court of Cook county, by the city of Chicago, against the Metropolitan City Bail way Company.
The bill alleges that on the 30th day of April, 1875, the common council of the city of Chicago passed an ordinance purporting to license said company to occupy, for horse railroad purposes, certain streets in the city; that the ordinance is void for several reasons stated in the bill, one of them being, that the ordinance was passed by the common council without ten days’ public notice having been given, as required by law, in some newspaper of…
