In this adversary proceeding the Court entered an Order on June 30, 1998, granting Plaintiffs motion for. summary judgment based in part upon the Court’s mistaken understanding that no opposition had been filed by the Defendant/Debtor Joseph George Lombardo (“Lombardo”) within the time limits set forth by the local rules. In fact, Lombardo filed an opposition on June 12, 1998, and a copy was received by this Court on August 10, 1998 1 Therefore, the Court’s Order of June 30, 1998, must be vacated and Plaintiffs motion for summary judgment decided after…
