—Judgment, Supreme Court, New York County (Howard E. Bell, J.), rendered June 18, 1992, convicting defendant, after a jury trial, of criminal possession of a controlled substance in the third and fourth degrees, and sentencing him, as a predicate felony offender, to concurrent terms of 5 to 10 years and to 7 years, respectively, unanimously reversed, on the law, the conviction vacated, and the matter remanded for a new trial.
