Plaintiff in error and Mike Laverdi were indicted by a grand jury in the criminal court pf Cook county. They were charged in the first count with stealing a horse, buggy and harness, the property of John Palisyranos, on October 9, 1914. The second count of the indictment charged the same persons with receiving stolen property. The third count charged the same persons with maliciously taking, driving and using the horse described in the first and second counts without the consent of Palisyranos, under paragraph 204 of the Criminal Code.
