Defendant was indicted for burglary in the third degree and grand larceny in the third degree and upon denial after a hearing of his motion to suppress physical evidence, he entered a plea of guilty to the burglary count in full satisfaction of the indictment. The primary issue presented on appeal is whether the seized evidence should be suppressed on the basis, as claimed by defendant, that he was unlawfully detained while the police pursued an investigation of whether a burglary had actually been committed.
