KERR, District Judge.

This controversy is the outgrowth of plaintiff’s sale of uranium properties in Fremont County, Wyoming, to defendants, the value of the purchase price of which was not readily ascertainable. It it a diversity action brought to recover such purchase price allegedly due and owing plaintiff by defendants. By the purchase agreement the purchase price was to be calculated on the basis of the net value of the ore developed under the terms of the agreement.
