This is an action for damages caused to dwelling houses and other property, the allegation being that the negligence of the defendant was the proximate cause of the damage. The main allegations of the declaration are as follows: That on November 18, 1930, and for many years prior thereto the defendant maintained a culvert over Waolani Stream at Wyllie Street; that in 1911 the defendant installed a large drain carrying storm waters from Nuuanu Street and in 1924 a second drain carrying flood waters from Alewa Heights, each emptying into the Waolani Stream…
