George Williams commenced suit against Charles Williams for a partition of certain lands in Wau-kesha county, devised to them jointly during their joint lives and, after the death of one, to the survivor and his heirs in fee, by their father, John Williams, by his will dated the 17th day of January, 1860. By said will there was given to the appellant, John H. Williams, a brother of *395the said George and Charles Williams, tne respondents, a legacy of $600.
