Plaintiff in error was defendant in the trial court and we will refer to him as the defendant.

*584An information was filed in the district court of Park county in which the defendant was accused of committing the crime of aggravated robbery. He first appeared before the trial court on October 16, 1961, at which time the following took place:

“THE COURT: Case No. 3558, People of the State of Colorado versus George Fred Allen and Charles Wayne Hansen.
“Is Mr. Allen present in Court?
“DEFENDANT ALLEN: Yes, sir.
