Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent Division of State Police Hearing Board which found petitioner guilty of misconduct.

An internal investigation by the State Police regarding missing evidence resulted in misconduct charges against petitioner, a State Trooper, for allegedly failing to obey a lawful order to truthfully answer questions and knowingly making a false entry in official records.
