In an action to recover damages for personal injuries, the defendant Sammey Ahmad appeals from an order of the Supreme Court, Kings County (Bayne, J.), dated July 20, 2016, which denied his motion to dismiss so much of the complaint as sought to recover punitive damages as against him.
Ordered that the order is modified, on the law, by deleting the provision thereof denying that branch of the motion of the defendant Sammey Ahmad which was to dismiss the sixth cause of action insofar as asserted against him, and substituting therefor a provision granting that branch of the motion; as so…
