OPINION

SUTIN, Judge.

This appeal raises the issue whether a person appointed as special prosecutor in a criminal case has authority to appoint another attorney to act as special prosecutor instead. In Defendant’s first trial, prosecuted by a special prosecutor appointed by the district attorney of the judicial district in which the case originated, the district court ordered a new trial. Defendant’s second trial was prosecuted by a second special prosecutor, this one appointed by the first special prosecutor.
