OPINION

RILEY, Judge.

STATEMENT OF THE CASE

Defendant-Appellant Richard W. Kremer appeals his convictions for operating a vehicle while intoxicated, a class A misdemean- or; 1 operating a vehicle with a .10% blood alcohol count (BAC) or more, a class C misdemeanor; 2 and operating a vehicle with a controlled substance (marijuana) in the blood, a class C misdemeanor. 3

We affirm in part and reverse in part.
