This suit grows out of the dedication of a street or public way by the appellee, Louisville and Jefferson •County Land Company, and the appellant, Consolidated Realty Company. The street or public highway dedicated by these, two companies is known as Emerson ave nue and divides the subdivision belonging to the Consolidated Realty Company on the northern side of Emerson avenue known as Strathmoor from a subdivision lying on the southern side of Emerson avenue belonging' to the Louisville and Jefferson Land Company known as Villula Park.
