NOONAN, District Judge.
This is a proceeding on a writ of ha-beas corpus to test the validity of the detention of one, Evsey S. Petrushansky, presently in the custody of the United States Marshal for the Southern District of New York.
On October 3, 1962 extradition proceedings were initiated at the request of the United Mexican States pursuant to a Treaty of Extradition proclaimed on April 22, 1899, 31 Stat. 1818 between Mexico and the United States.
