This is a personal injury suit against the City of Dallas by Mrs. Bessie Shuford. The verdict and judgment were in her favor for $1,000. The city appealed. A majority of the Court of Civil Appeals upon original hearing ordered that the judgment be reversed and the cause remanded. Associate Justice Young dissented on the ground that issues were raised by the evidence which should have been submitted to the jury. Upon rehearing the Court by the same majority, having concluded it was not necessary “that any additional matter of fact be ascertained,” reformed its original judgment and decreed…
