This action presents a facial challenge to the constitutionality of section 21 of the Massachusetts Charitable Solicitation Act, M.G.L. c. 68 § 21 (“section 21”), which limits a professional solicitor’s compensation to twenty-five percent of any moneys raised. 1 The matter is now before the Court on cross motions for summary judgment, one filed by the Massachusetts Attorney General, to compel Telco Communications Inc.
