This is an appeal from the judgment of the court below in discharging a rul^ to set aside the assessment of damages and open the judgment in ejectment and let the defendant into a defense. The Philadelphia Warehousing and Cold Storage Company, a corporation, and H. M. Ambler entered into an agreement by which the former leased to the latter a certain pier No. 30, North Delaware avenue, Philadelphia. In the negotiations the corporation was represented by W. T.
