This suit was brought by Elee Piner, hereafter referred to as plaintiff, against Sid Westheimer Company, hereafter referred to as defendant. Plaintiff alleged that the defendant was a corporation incorporated under the laws of the state of Texas engaged in the general business of funeral directors and embalmers and that it operated automobile ambulances in and around the city of Houston, Tex.
