Wm. Basey, doing business as Wm. Basey Company, commenced its action against the Chicago, Rock Island & Pacific Railway Company, the Eagle-Bock Products Sales Company, and R. L. Wharton, for the loss of several cases of beverage ■ carriers at Oklahoma City. The (■rial of the cause resulted in judgment for the plaintiff, and against all of the defendants. The railway company has appealed the cause, and assigns as error for reversal that the instructed verdict in favor of the plaintiff is against the law and the evidence.
