GARDNER, Circuit Judge.

This is a personal injury action in which the appellee as plaintiff brought suit against the appellant to recover damages suffered by appellee as the result of an automobile collision. The parties will be referred to as they appeared in the lower court. At the time of receiving his injuries, the plaintiff was riding with his brother in the driver’s seat of a truck driven by his brother.
