GARDNER, Circuit Judge.

This is an appeal from a judgment based upon a verdict directed in favor of the appellee, -plaintiff below, in an action brought to recover on a fidelity bond. We shall re*469fer to the parties as they were designated in the lower court.

The Ward-Garrison Hotel Corporation on August 12, 1935, filed its petition for reorganization under section 77B of the National Bankruptcy Act, 11 U.S.C.A. § 207 and note.
