Error to Monroe; Kinne, J. Assumpsit by Octavia Roberts against Edward J. Druillard for breach of promise of marriage. From a judgment for plaintiff, defendant brings error.

In an action for breach of promise of marriage, the court permitted plaintiff’s counsel to prove various slanderous statements concerning the plaintiff, made by the defendant to third parties at different places and times, after the relations had ended, in the absence of the plaintiff, as a reason for breaking his engagement and refusing to marry her. There is no doubt that this testimony was admissible under authorities hereinafter cited, but an improper use was made of it. The court instructed the jury that:
