This action was begun in the district court of Tillman county, Olcla., on. the 18th day of November, 1922, by plaintiff against the defendants J. M. Jones and A. J. Allison separately, but by agreement said two causes of action have been consolidated and tried as one. The petitions filed were exactly the same, except in the names of the defendant, description of land, and amount. The petition in the case against J. M.
