CHASEZ, Judge.

This is an action by plaintiff, Lawrence M. Sicard, endeavoring to recover workmen’s compensation benefits from the defendant, the City of New Orleans. From a judgment in favor of the plaintiff, defendant appeals.

The record reflects that plaintiff was employed as a process server of the Juvenile Court of the Parish of Orleans. On December 16, 1963, while in the course and *673scope of his employment, defendant met with an automobile accident in which he sustained serious injuries.
