Betty Wesley,, a resident of the 'Indian Territory, died in December, 1903, in that portion of said territory embraced within the Central judicial district and the Antlers division, and on the 1st day of February, 1905, the relator, Elias Wesley, the surviving husband of the deceased, was, by the United States court for the Central district of the Indian Territory, sitting at Antlers, duly appointed administrator of her estate, and duly qualified as such.
