FACTS

Plaintiff is pursuing, under diversity jurisdiction, a cause of action for wrongful cancellation of two life insurance policies issued by defendant on plaintiff’s life, and a cause of action for the present cash value of those policies. The two life insurance policies and an income protection disability policy were issued on the basis of a single application submitted by plaintiff in 1963. Later that same year plaintiff obtained waiver of premium provisions which were added to the life insurance policies…
