Tlae appellant. .Ben Herndon, wásytrjed and convicted in the Fayette circuit court on June'21, 1893, of the crime of housebreaking, and sentenced'to . three years in the penitentiary. On July 2, 1895, he was pardoned by the Governor for this crime. Afterwards, and at the April term of the same court, 1897, he was tried and convicted of the crime of maliciously shooting John Jackson, and his punishment fixed at one year in the penitentiary.
