The plaintiff brought his action against *139the defendant in the Court of Common Pleas for Lexington County, in this State, to recover damages for injuries to his timber. The defendant set up, amongst other things, a counterclaim against plaintiff. These issues came on for trial before Judge Witherspoon and a jury at the spring term, 1893, and resulted in a verdict for defendant in the sum of $600. This verdict was ordered by the judge to be set aside, unless all but $200 was remitted by defendant. This remittitur was entered. After…
