The defendant was convicted of murder of the second degree, and his counsel made a motion for an arrest of judgment and a new trial and filed several *259reasons in support thereof. While a great number of reasons are assigned, at the time of the argument counsel for the defendant particularly emphasized three or four of the reasons assigned, and the first was the right of the trial judge to sit at the time of the trial.
