MEMORANDUM AND ORDER

SARIS, District Judge.

INTRODUCTION

On May 17, 2002, a Massachusetts jury convicted Petitioner Ernest Likely of un lawful distribution of a controlled substance (cocaine) within one thousand feet of a public school. During trial, in accordance with then-existing Massachusetts law, the judge allowed the government to introduce into evidence a certificate of analysis by a chemist, prepared pursuant to Mass. Gen. Laws ch. Ill, § 13, to establish that the substance distributed was cocaine.
