FRIEDMAN, Circuit Judge.

This is an appeal from a judgment of the United States Claims Court,* setting aside the termination of the appellee’s employment with the Veterans Administration (“VA”) as a physician on the ground that *1071prior to such termination the agency had not counseled appellee and provided her with a copy of her proficiency report pursuant to the requirements of its regulations. We reverse and remand to the Claims Court to decide the remaining issue in the case, which it did not reach.
