— This action was instituted by appellees to compel Jacob' H. Hilkene, as commissioner of buildings of the city of Indianapolis, to approve certain plans and specifications for a metal canopy or awning to. be erected over the sidewalk in front of a moving picture theatre owned and operated by appellees in said city, and to authorize the issuance of a permit for the construction of the same.
