Kourtney Jay Kennedy (“Movant”) appeals from a denial of post-conviction relief in a Rule 27.261 proceeding. In his motion, it is claimed that movant’s Sixth Amendment right to effective assistance of counsel was denied when his trial attorney failed to perfect an appeal from his conviction in the underlying case. Movant raises three points on appeal. Two points are interrelated.
