— On March 22d, 1878, the appellants Williams and Helm, the former as principal, the latter as surety, executed their note to the appellee, the First .National Bank, in the sum of $600, with attorney fees, payable ninety days after date. On the 22d day of May following, Williams executed his note to said bank for $3,200, payable one day after *45date, and secured the same by his mortgage on real estate in Wells county. The bank obtained judgment, December 31st, 1878, in the Huntington Circuit Court, against Williams as principal and Helm as surety on said note of $600, for the full amount…
