Error to a judgment of the Corporation Court of the city of Lynchburg, on a petition filed asking to have a license tax refunded. To an adverse judgment the petitioner assigns error.

The Virginia Brewing Company filed its petition in the Corporation Court of the city of Lynchburg, to have refunded io it a tax with which it claims to have been erroneously assessed, and which, it paid involuntarily and under protest. The Commonwealth's *146attorney for the city of Lynchburg appeared and made defense to the petition, and the case was heard upon facts agreed between the attorneys for the petitioner and the Commonwealth; and thereupon the corporation court dismissed the petition, a bill of exceptions was taken to the ruling, and the…
