William D. Mayfield, Jr., (defendant) was charged as a persistent offender with driving while intoxicated, §§ 577.010 1 and 577.023.3, and with murder in the second degree, § 565.021.1(2). Defendant waived his right to trial by jury. He was tried by the trial court without a jury and found guilty of both offenses. He contends on appeal that the evidence was not sufficient for the trial court to have found him guilty beyond a reasonable doubt; that he was not proven to be the driver of the vehicle that was the basis for the 'charges of which he was found guilty.
