Plaintiff Siteworks Contracting Corporation (herein, “Plaintiff’) commenced suit in this Court against Western Surety Company (herein, “Defendant Western”) on De cember 10, 2004, for an alleged breach of contract. See Docket # 1, Plaintiffs Complaint (herein, “Comp.”) at ¶ 3.
