MEMORANDUM OPINION AND ORDER
COHN, District Judge.
Petitioner, Porfidio Rae Acosta, presently confined at the Michigan Department of Corrections’ Muskegon Temporary Facility in Muskegon, Michigan, has filed this pro se application for writ of habeas corpus pursuant to 28 U.S.C. § 2254. On October 23, 1967, a jury in Oakland County Circuit Court convicted petitioner of the first degree murder of his girlfriend. The trial judge sentenced him to life imprisonment.
