The defendant was convicted following a jury trial presided over by this court of one count of assault in the second degree and five counts of criminal possession of a forged instrument in the second degree. The trial evidence indicated that on the evening of December 27, 2013, a uniformed police officer, Arthur McCarthy, observed the defendant apparently attempt to sell tickets to a New York Knicks basketball game to a couple at the entrance to Madison Square Garden in New York County in violation of a statute prohibiting the sale of such tickets…
