The issues involved in this transfer are whether the court erred in denying the defendant’s motion to suppress certain evidence and whether the court committed error in its instruction to the jury. Defendant was charged with aggravated assault, in violation of RSA 631:2, and a verdict of guilty was returned by a jury. All questions of law were reserved and transfered by King, J.
